Please read our <a href=\"https:\/\/globalnews.ca\/pages\/global-news-commenting-policy\/\" target=\"_blank\" title=\"Facebook commenting policy\" rel=\"noopener\">Commenting Policy<\/a> first.<br \/>The case of a doctor who says he was driven out of New Brunswick by racism and bullying on social media points to a need for further regulation in an increasingly digital age, according to an expert in law and technology.<br \/>Dr. Jean-Robert Ngola said he was forced to leave his community of Campbellton, N.B., due to the community shunning he faced after he was falsely accused of sparking a <a href=\"http:\/\/globalnews.ca\/tag\/covid-19\">COVID-19<\/a> outbreak in May 2020. He now lives in Quebec.<br \/>Last week, he <a href=\"https:\/\/globalnews.ca\/news\/8523124\/jean-robert-ngola-lawsuit-nb-rcmp-facebook\/\">launched a lawsuit<\/a> against the province of New Brunswick and the RCMP, alleging they colluded to investigate and blame him for the outbreak.<br \/> \t\t\t<span class=\"c-readmore__label\"><strong>Read more: <\/strong><\/span> \t\t\t\t<a class=\"c-readmore__link\" href=\"https:\/\/globalnews.ca\/news\/8523124\/jean-robert-ngola-lawsuit-nb-rcmp-facebook\/\" data-track-region=\"content-read-more\" title=\"Doctor accused of spreading COVID-19 launches lawsuit against N.B., RCMP and Facebook\"> \t\t\t\tDoctor accused of spreading COVID-19 launches lawsuit against N.B., RCMP and Facebook\t\t\t\t<\/a> \t\t<br \/>But in an unexpected move, the lawsuit also named Facebook as a defendant, alleging the social media giant \u2014 which recently rebranded as &#8220;Meta&#8221; \u2014 was responsible for the rapid spread of misinformation about his case and permitted hateful comments about him to flourish.<br \/>\u201cI think it\u2019s a really interesting lawsuit and I think it brings up a lot of the problems we see when it comes to addressing online harms,\u201d said Suzie Dunn, an assistant professor in law and technology at Dalhousie University in Halifax.<br \/>Ngola, who is from Congo, said he was harassed over Facebook after New Brunswick Premier Blaine Higgs told a news conference that an \u201cirresponsible\u201d medical professional was to blame for the outbreak, which infected 40 people and killed two.<br \/>While Higgs did not name Ngola, the lawsuit said he had already been identified on social media when Higgs made those comments, so it was easy for the public to connect the dots.<br \/>The lawsuit alleges the doctor was doxxed, stalked, and mobbed by death threats and racist insults. According to the statement of claim, he received lynching threats, was called a refugee and told to go back to Africa.<br \/> \t\t\t<span class=\"c-readmore__label\"><strong>Read more: <\/strong><\/span> \t\t\t\t<a class=\"c-readmore__link\" href=\"https:\/\/globalnews.ca\/news\/8529008\/jean-robert-ngola-case-immigration-doctor-recruitment\/\" data-track-region=\"content-read-more\" title=\"Ngola case \u2018definitely bad PR\u2019 for immigration, doctor recruitment in New Brunswick\"> \t\t\t\tNgola case \u2018definitely bad PR\u2019 for immigration, doctor recruitment in New Brunswick\t\t\t\t<\/a> \t\t<br \/>\u201cFacebook exacerbated the mistreatment of Dr. Ngola due to its reluctance to adequately monitor, stop, remove malicious and misleading content from the platform, in direct violation of its community standards,\u201d said the statement of claim.<br \/>Ngola\u2019s legal team is seeking three per cent of Facebook\u2019s net worldwide profit \u201cas punitive damages are required to catch the attention of the social media industry.\u201d During the July-September period in 2021, the company&#8217;s <a href=\"https:\/\/globalnews.ca\/news\/8324789\/facebook-q3-earnings-leaked-documents\/\">revenue grew by 35 per cent<\/a> to $29.01 billion.<br \/>While this is the first legal case of this nature in Canada that Dunn is aware of, people being harassed over Facebook is nothing new.<br \/>She pointed to the case of Gretchen Roedde, a northern Ontario physician who plans to close her practice due to the cyberbullying she faced after she was falsely accused by a local councilman of denying care to unvaccinated patients.<br \/>&#8220;This isn&#8217;t the first time that this has happened, where misinformation around COVID \u2014 which people are feeling very sensitive about \u2014 has led to somebody being driven out of town,&#8221; Dunn said.<br \/>&#8220;Especially doctors right now, who are so overworked, who are facing an incredible amount of pressure &#8230; and then you have the community that you&#8217;re in come after you over something that&#8217;s untrue. I can see how it would be incredibly intolerable.&#8221;<br \/>Dunn noted that \u2014 as was revealed during the <a href=\"https:\/\/globalnews.ca\/news\/8240898\/facebook-profits-hate-speech-whistleblower-claims\/\">Facebook congressional hearings<\/a> in October 2021 \u2014 there is profit to be made from allowing hateful content to fester online, since profit is tied to engagement.<br \/>And what tends to attract engagement is \u201cnot neutral content, it\u2019s extreme content,\u201d said Dunn \u2014 whether it\u2019s a controversial post that inspires bickering in the comments section, or extremely positive content like an engagement or pregnancy announcement.<br \/>In Ngola\u2019s case, where so many people in the small community were interested in discussing the matter, that was bound to drum up some online engagement as well \u2014 with much of it turning nasty.<br \/> \t\t\t<span class=\"c-readmore__label\"><strong>Read more: <\/strong><\/span> \t\t\t\t<a class=\"c-readmore__link\" href=\"https:\/\/globalnews.ca\/news\/8240898\/facebook-profits-hate-speech-whistleblower-claims\/\" data-track-region=\"content-read-more\" title=\"Facebook prioritized profits over calming hate speech, whistleblower claims\"> \t\t\t\tFacebook prioritized profits over calming hate speech, whistleblower claims\t\t\t\t<\/a> \t\t<br \/>\u201cYou know these companies are profiting in some ways from some of the negative engagements that are happening on Facebook and Twitter and various companies,\u201d she said.<br \/>\u201cAnd so you are starting to see this question: at what point does content on Facebook or other social media cross the line from being something that shouldn\u2019t be Facebook\u2019s responsibility to manage, to them actually being an agent of harm?\u201d<br \/>Dunn doesn\u2019t believe Facebook should hold responsibility for \u201cevery mean or nasty comment\u201d made on its platform, but she said when those comments cross into hate campaigns, \u201cat a certain point I think social media companies have some responsibility to behave well and recognize their role in creating healthy dialogue on the internet.\u201d<br \/>There isn\u2019t much oversight in the online world, either. Canada has <a href=\"https:\/\/globalnews.ca\/news\/8503534\/social-media-influenced-government-regulation\/\">not yet passed substantial legislation<\/a> to rein in powerful tech giants \u2014 though the federal government did <a href=\"https:\/\/globalnews.ca\/news\/8069998\/hate-speech-online-regulation-canada\/\">propose a new Digital Safety Commission<\/a> in July 2021, shortly before calling a federal election.<br \/>In Nova Scotia, there is an Intimate Images and Cyber-Protection Act, which is the first of its kind in Canada. So far, it\u2019s been used to curb harassment from individuals, rather than holding the companies that allow the cyberbullying to happen to account.<br \/>\u201cWhen you think about the ways our laws are framed, it\u2019s often like an individual to an individual,\u201d said Dunn.<br \/>\u201cWhen it comes to online harassment or cyberbullying outside of the criminal context, there\u2019s not a lot of options for people.\u201d<br \/> \t\t\t<span class=\"c-readmore__label\"><strong>Read more: <\/strong><\/span> \t\t\t\t<a class=\"c-readmore__link\" href=\"https:\/\/globalnews.ca\/news\/8503534\/social-media-influenced-government-regulation\/\" data-track-region=\"content-read-more\" title=\"The dark side of social media: What Canada is \u2014 and isn&#8217;t \u2014 doing about it\"> \t\t\t\tThe dark side of social media: What Canada is \u2014 and isn&#8217;t \u2014 doing about it\t\t\t\t<\/a> \t\t<br \/>Dunn said while any sort of regulations or laws surrounding social media must be weighed against freedom of expression, more oversight is needed.<br \/>\u201cPeople are recognizing that social media companies have an incredible amount of power, and them not regulating even what\u2019s forbidden on their own content moderation policies is causing real, severe social harms that need to be addressed,\u201d she said.<br \/>\u201cClearly, these large social media companies have not taken full responsibility themselves and aren\u2019t engaging in adequate content moderation, and so at a certain point if they\u2019re not going to do it themselves, we need government regulations to moderate some of this more harmful behaviour.\u201d<br \/> \t\t\t<span class=\"c-readmore__label\"><strong>Read more: <\/strong><\/span> \t\t\t\t<a class=\"c-readmore__link\" href=\"https:\/\/globalnews.ca\/news\/8353819\/google-canada-online-hate-plan\/\" data-track-region=\"content-read-more\" title=\"Google warns Canada&#8217;s plan to fight online hate is &#8216;vulnerable to abuse&#8217;\"> \t\t\t\tGoogle warns Canada&#8217;s plan to fight online hate is &#8216;vulnerable to abuse&#8217;\t\t\t\t<\/a> \t\t<br \/>Facebook\/Meta declined to comment on the case when reached by Global News last week. \u201cWe can\u2019t comment on pending litigation,\u201d a spokesperson said in an email.<br \/>Dunn said she will see how the Ngola lawsuit plays out and if that will have an impact on future regulation for big social media companies.<br \/>\u201cIt\u2019ll be interesting to see.
